Introduction
Welcome to Resonare! These Terms of Service ("Terms") govern your use of the Resonare mobile application ("App") operated by Resonare ("we," "us," or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Eligibility
You must be at least 13 years old to use Resonare. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.
2. Your Account
2.1 Account Creation
To use certain features of the App, you must create an account using Google Sign-In or Apple Sign-In. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
2.2 Account Information
You agree to provide accurate, current, and complete information when creating your account and to update such information to keep it accurate, current, and complete.
2.3 Account Security
You are responsible for safeguarding your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
3. User-Generated Content
3.1 Your Content
You may create, upload, and share content through the App, including but not limited to:
- Album ratings and reviews
- Diary entries and notes
- Profile information and biography
- Comments and interactions with other users
3.2 Content Ownership
You retain ownership of the content you create. However, by posting content on Resonare, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App and for promotional purposes.
3.3 Content Responsibility
You are solely responsible for your content. You agree that your content will not violate these Terms or our Community Guidelines.
4. Prohibited Conduct
You agree NOT to:
- Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Harass, bully, intimidate, or threaten other users
- Post hate speech or content that discriminates against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
- Impersonate any person or entity or misrepresent your affiliation
- Post spam, advertisements, or promotional material without authorization
- Attempt to gain unauthorized access to other users' accounts or our systems
- Use the App for any illegal purpose or in violation of any laws
- Interfere with or disrupt the App or servers
- Collect or harvest user information without consent
- Use automated systems or bots to access the App
5. Content Moderation
5.1 Our Rights
We reserve the right to review, monitor, and remove any content that violates these Terms or our Community Guidelines. We are not obligated to monitor all content but may do so at our discretion.
5.2 Reporting
You can report objectionable content or abusive users through the in-app reporting feature. We commit to reviewing and acting on reports within 24 hours.
5.3 Consequences
Violations of these Terms or our Community Guidelines may result in:
- Removal of offending content
- Warning to your account
- Temporary suspension of your account
- Permanent termination of your account
6. Blocking Users
You may block other users at any time. When you block a user:
- They will not be able to see your profile or content
- They will not be able to follow you or interact with you
- Any existing follow relationship will be removed
7. Intellectual Property
7.1 Our Property
The App and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of Resonare and its licensors. The App is protected by copyright, trademark, and other laws.
7.2 Third-Party Content
Album information, artwork, and metadata displayed in the App are provided by Spotify and remain the property of their respective owners. We do not claim ownership of this content.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.
9. Termination
9.1 By You
You may terminate your account at any time by deleting your account through the App settings or by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.
9.2 By Us
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
10. Disclaimers
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE APP'S OPERATION, AVAILABILITY, OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RESONARE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
12. Indemnification
You agree to indemnify and hold harmless Resonare and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the App or violation of these Terms.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last Updated" date and, for material changes, by providing notice through the App or via email.
Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
